Yes. But this is not important if you are using another model other than IEEE 1584. The exception never existed except in IEEE 1584. The wording in IEEE 1584 is tenuous anyways, but does provide a relatively simple (perhaps too simple) way to reject low end cases.

I've had burns on my fingers. This doesn't prove anything though because the 70E standard as well as IEEE 1584 is to prevent a fatality, not to prevent injury. Even then, the probability of success is 95% in a worst case scenario. The question is whether or not there has been a fatality from an arc flash at that voltage/kVA rating.
