Try to keep this as short as possible. We had an Arc Flash study done in 2018, which I was not happy with and stated so. We did not get an official signed copy of the report, nor did they update all tags to the new date and did not cover all the panels they should have. Company was bought out by a bigger contractor who states they are not responsible or liable for the old company and will not update the study the old company did. First, is the new company responsible for the work of the old they bought..in Minnesota. Will they be responsible for missed labels and missed panels.... any help much appreciated. TY |

I don't know about specifics of Minnesota law, however I think most companies only purchase assets, like name, employees, and customer lists, and not liabilities, like warranties. Your request would likely need to be addressed by the new company under 'continuing customer relationships'. |

Sad a company would do a customer that way. The previous responder is correct if they purchased the assets only. However the previous company could be sued against their errors and omissions insurance. Probably not worth it since the cost of suing them would likely be more than getting the study updated. Always request the digital files from the engineering CAD software done so you can fix or have a study redone in these types of events. Saves thousands vs. redoing a study. Hopefully you have a oneline with documentation. Using the new company means they might have the files. If so you could probably petition them to give them to you if you don't want to use them for the study. Good luck, Hugh Hoagland e-Hazard.com |

Before getting involved in any legal action, check the scope of work of the arc flash quote. Many companies offer a limited scope of work considering only to include circuits fed by OCPDs equal to or greater than 100A. This makes a lot of sense and the price of the AFHA is much less. For circuits of less than 100A, some companies offer to print and affix generic arc flash labels. If you have any additional questions, please contact me. Thanks. |
