Si alguien realiza trabajos el\u00e9ctricos con corriente el\u00e9ctrica sin la formaci\u00f3n adecuada, los resultados pueden ser catastr\u00f3ficos y mortales. He visto que esto sucede con regularidad durante las investigaciones de accidentes y los casos legales. La v\u00edctima no recibi\u00f3 la formaci\u00f3n adecuada o tal vez ignor\u00f3 algunos pasos del programa de formaci\u00f3n sobre seguridad el\u00e9ctrica.<\/p>

Muchas empresas son muy proactivas y se aseguran de que sus empleados no solo est\u00e9n capacitados, sino que tambi\u00e9n reciban capacitaci\u00f3n de actualizaci\u00f3n al menos cada tres a\u00f1os seg\u00fan los requisitos de la norma NFPA 70E. Muchas incluso utilizan intervalos m\u00e1s cortos para la capacitaci\u00f3n de actualizaci\u00f3n o las actualizaciones. Sin embargo, un problema inminente es que para algunas empresas, la capacitaci\u00f3n est\u00e1 muy abajo en la lista por diversas razones o no fue muy completa. He visto muchas empresas que simplemente quieren "marcar la casilla"<\/strong> es decir, afirman que recibieron capacitaci\u00f3n sin prestar mucha atenci\u00f3n a cu\u00e1l era el contenido y lo marcan en su lista de tareas pendientes. Despu\u00e9s de todo, \u00bfQu\u00e9 podr\u00eda salir mal?<\/strong><\/p>

Obviamente, esto tiene mucha importancia. La vida de alguien puede depender de ello, literalmente. Seg\u00fan mi propia experiencia como testigo experto, he aqu\u00ed una de las formas en que la falta de formaci\u00f3n se manifiesta en el \u00e1mbito jur\u00eddico.<\/p>

Capacitaci\u00f3n y abogados en seguridad el\u00e9ctrica<\/h3>

La historia suele comenzar de la misma manera. Recibo una consulta de un abogado que me pregunta si estoy interesado en participar en una investigaci\u00f3n de un incidente el\u00e9ctrico en el que alguien result\u00f3 herido o muri\u00f3.<\/p>

OSHA fomenta el uso del t\u00e9rmino \u201cincidente\u201d en lugar de \u201caccidente\u201d porque \u201caccidente\u201d implica que el evento era inevitable. Por lo general, este no es el caso. La mayor\u00eda de las veces, la lesi\u00f3n o la muerte eran evitables y fueron el resultado de una aver\u00eda en alg\u00fan lugar.<\/p>

Ya sea que el incidente haya involucrado un arco el\u00e9ctrico o una electrocuci\u00f3n, los detalles suelen ser bastante gr\u00e1ficos y las emociones deben mantenerse al margen de la investigaci\u00f3n. La reuni\u00f3n inicial suele tener lugar en un bufete de abogados, donde se re\u00fane el equipo para analizar los detalles que llevaron al incidente. Esto normalmente incluye escuchar las descripciones de la lesi\u00f3n, ver fotograf\u00edas e intentar conectar los puntos de lo que sucedi\u00f3.<\/p>

Despu\u00e9s de que todos hayan hecho sus presentaciones y sea mi turno, generalmente comienzo con una pregunta simple: \u201c\u00bfEstaba la persona calificada para realizar el trabajo?\u201d Muchas veces, la respuesta es algo como: \u201cS\u00ed, era la persona de mayor rango en la empresa y ten\u00eda a\u00f1os de experiencia\u201d. En este punto, a menudo tengo que continuar con \u201cEso no es lo que quise decir con la pregunta. Echemos un vistazo a la definici\u00f3n de persona calificada de la norma NFPA 70E\u201d.<\/p>

Seg\u00fan la edici\u00f3n 2018 de la Norma NFPA 70E para Seguridad El\u00e9ctrica en el Lugar de Trabajo, la definici\u00f3n de Persona Calificada es:<\/p>

Persona que ha demostrado habilidades y conocimientos relacionados con la construcci\u00f3n y operaci\u00f3n de equipos e instalaciones el\u00e9ctricas y ha recibido capacitaci\u00f3n en seguridad para identificar los peligros y reducir el riesgo asociado. \u00a0<\/em><\/p>

Un componente muy importante de esta definici\u00f3n es la fase \u201crecibi\u00f3 capacitaci\u00f3n en seguridad para identificar y evitar los peligros\u201d. NFPA 70E 110.2(A) proporciona los requisitos para la capacitaci\u00f3n de los empleados expuestos a peligros el\u00e9ctricos cuando el riesgo del peligro no se reduce a un nivel seguro.<\/p>

Capacitaci\u00f3n en seguridad el\u00e9ctrica: m\u00e1s que simplemente presentarse<\/h3>

El hecho de que una persona haya asistido a un programa de formaci\u00f3n no significa necesariamente que haya prestado atenci\u00f3n. Uno de esos casos que he tenido es el de una persona que result\u00f3 gravemente herida en un arco el\u00e9ctrico. Aunque sobrevivi\u00f3, sufri\u00f3 quemaduras de tercer grado en los brazos y el pecho y perdi\u00f3 varios dedos. Durante el proceso de descubrimiento, se revel\u00f3 que hizo<\/em> Asistir a un programa de capacitaci\u00f3n sobre seguridad el\u00e9ctrica. Esto qued\u00f3 documentado e incluy\u00f3 un formulario de asistencia al curso con su firma.<\/p>

Sin embargo, esto parec\u00eda desconcertante porque se hab\u00edan tomado muchas medidas relacionadas con la seguridad el\u00e9ctrica. \"Sunglasses\"O bien se realiz\u00f3 incorrectamente o se omiti\u00f3 por completo durante los eventos que llevaron al arco el\u00e9ctrico. Algo no cuadraba. M\u00e1s tarde durante el caso, la parte lesionada pas\u00f3 por el proceso de declaraci\u00f3n que requiere responder preguntas bajo juramento. Afirm\u00f3 que asisti\u00f3 a la capacitaci\u00f3n, sin embargo, durante el interrogatorio de seguimiento, admiti\u00f3 que estaba en la parte de atr\u00e1s de la clase con gafas de sol puestas, durmiendo.<\/p>

Como he estado involucrado en la capacitaci\u00f3n en electricidad durante m\u00e1s de 30 a\u00f1os, a menudo es f\u00e1cil saber qui\u00e9n est\u00e1 interesado y qui\u00e9n no. La energ\u00eda de una clase fluye y refluye, y saber c\u00f3mo juzgar esto le permite al capacitador ajustar la presentaci\u00f3n y mantener el inter\u00e9s. Un componente muy importante de un programa de capacitaci\u00f3n en seguridad el\u00e9ctrica es tener un cuestionario al final. Anunciarlo al comienzo de una clase ayuda a \u201cmotivar\u201d a los participantes y mantenerlos interesados. Mis clases de capacitaci\u00f3n en seguridad el\u00e9ctrica \/ NFPA 70E<\/strong>Cuando anuncio que habr\u00e1 un examen al final, a menudo se oye un gru\u00f1ido colectivo en la clase. Ahora saben que realmente tienen que prestar atenci\u00f3n.<\/p>

Un buen programa de capacitaci\u00f3n en seguridad el\u00e9ctrica es una inversi\u00f3n de tiempo y recursos financieros.
